PLEASE READ THESE TERMS OF USE (THIS “AGREEMENT”) CAREFULLY. THEY DESCRIBE IMPORTANT RIGHTS AND RESPONSIBILITIES ASSOCIATED WITH USING WWW.AND-ED.COM, IT’S RELATED SITES, OUR SERVICES AND OUR ONLINE INFORMATION

This Agreement outlines the terms of your relationship with Andersen Education (“Andersen,” “we,” “our,” or “us”) and governs your access to and use of our services and websites, including www.and-ed.com and related subdomains (collectively, “Sites”), as well as any tutoring, test prep, coaching, or educational services (“Services”) we provide.

 

By using our Services, registering on our Sites, or checking the box acknowledging this Agreement, you confirm that you’ve read, understood, and agreed to the terms outlined here. If you don’t agree, please do not use our Sites or Services.

 

1. Who You Are

You represent that you are a custodial parent or legal guardian of the student receiving services (“your student”) and are entering into this Agreement on their behalf (and also, if applicable, on behalf of any other parent/guardian listed on your registration form).

 

2. Services

We provide tutoring, test prep, coaching, and educational services via phone, email, remote platforms (e.g., Zoom, Google Meet, Skype, FaceTime), in person at your apartment or a mutually agreed upon location such as a library or a coffee shop. Services are billed at the hourly rate outlined in your “Next Steps” email. We reserve the right to assign tutors or coaches, adjust schedules, withhold or discontinue services at our discretion. Engaging in Services with us means you accept the terms outlined in this document.

 

3. Scheduling, Cancellations & Missed Sessions

  • Scheduling: Sessions are scheduled on a mutually agreed-upon basis.

  • Cancellations: Sessions must be canceled or rescheduled at least 24 hours before the scheduled starting time of the session. Cancellations or reschedules with less than 24 hours before the starting time of the session or no-shows are charged in full.

  • In-Person Policy: There must always be an adult home at all times. 

  • In-Person Illness Policy: If a student who typically meets in person becomes ill with less than 24 hours’ notice, there are two options: switch the session to a remote platform at the scheduled time, or cancel the session, which will still be subject to the standard late cancellation fee.

  • Lateness or Leaving Early: We do not extend sessions or provide refunds for missed time due to student lateness or early departure.

4. Fees and Payments

  • Hourly Rate: You agree to pay the non-refundable rate outlined in your Next Steps email. Andersen Education reserves the right to adjust our rates on an annual basis. Any updated rate will be communicated in writing in advance of implementation. If you do not agree to the new rate, you may choose to discontinue Services. Continued use of Services after a rate adjustment constitutes acceptance of the updated rate.

  • Billing: Invoices are issued every Monday for the upcoming week’s sessions, and payment is due upon receipt. If a student’s first session is scheduled before the following Monday, that session will also be invoiced and must be prepaid at the time of booking. In the event of a failed payment (including but not limited to declined cards or insufficient funds), the client will have forty-eight (48) hours from the invoice date to correct the payment.

  • Late Fees: A $25 fee applies to late invoices. Payments not received within the forty-eight (48) hour grace period will be considered late, and we reserve the right to pause Services until payment is received in full.

  • Payment Methods: We accept ACH, debit, and credit cards. American Express is not accepted. A 3% processing fee applies to debit/credit card payments.

  • Credit Card Authorization: By providing your card, you authorize recurring billing for Services. By providing your debit or credit card information, you authorize Andersen Education to charge your card through our billing system (Stripe via TutorBird) for any fees associated with Services rendered. Charges will appear on your statement as ANDERSEN EDUCATION. Your card information will be securely stored on file, and recurring payments will be processed according to our weekly billing cycle.You may cancel recurring billing at any time by contacting us at least 24 hours in advance to either cancel the associated session or arrange for an alternate form of payment. Your card will be charged for any session that is not canceled at least 24 hours before the scheduled start time. If you have any questions or concerns about a charge or your account, you agree to contact us directly at remy@and-ed.com before disputing any charges with your bank or card provider. You confirm that you are the authorized cardholder and legally permitted to enter into this recurring payment arrangement.

  • Nonrefundable Services: All fees and charges are nonrefundable and will not be pro-rated for any partial use or termination. This applies to all prepaid services, including weekly tutoring sessions, group classes, and packages.

  • Missed or Rescheduled Sessions: If you provide at least 24 hours’ notice, the prepaid fee for that session will automatically be applied to your next scheduled session. Sessions canceled with less than 24 hours’ notice will be forfeited and not credited, refunded, or carried over.

5. Tutor Assignments and Direct Compensation

You agree not to hire or pay any of our tutors or professionals directly for any Services outside of Andersen Education. Doing so violates this Agreement. All payments must go through us.

 

6. Session Format

Remote sessions require you to have a working internet connection and to test your software and equipment in advance. We are not responsible for issues on your end that affect session quality or length.

 

7. Technical or Operational Changes

We reserve the right to modify or cancel sessions due to staffing, enrollment, weather, or technical issues. We’ll give you as much notice as possible.

 

8. Personal Information & Privacy

We collect and use your personal information as outlined in our Privacy Policy, including your name, contact info, and payment details, solely to administer services and communicate with you. We never sell or share your data with third parties for marketing purposes.

 

9. Your and Your Student’s Responsibilities

You acknowledge and agree that you and your student are solely responsible for evaluating any recommendations, strategies, or advice provided by Andersen Education or your tutor. It is up to you and your student to decide whether or not to act on such guidance. We encourage thoughtful engagement, but the decision to follow through rests entirely with you.

 

10. No Guarantees

We do not guarantee specific results, grades, or test scores. All fees are fully earned, payable, and due upon delivery of Services—regardless of the outcome or whether you or your student ultimately find the Services useful. If you are dissatisfied for any reason, your sole remedy is to discontinue Services. You will remain responsible for any outstanding fees already incurred. Refunds will not be issued unless we explicitly agree to do so in writing at our sole discretion. Fees are nonrefundable unless we explicitly agree otherwise in writing.

11. Billing Issues & Disputes

You must report any billing errors within 15 calendar days of the invoice date. By continuing to use our Services, you acknowledge the charges as valid unless disputed in that window. Please contact us before initiating a chargeback—we’re happy to work with you to resolve any issues.

 

12. Binding Arbitration

If a dispute arises and we’re unable to resolve it together in good faith, we agree to resolve the matter through binding arbitration rather than through court proceedings.

 

13. Termination

You may terminate this Agreement and stop using our Services at any time with written notice. Executive Function packages must be terminated at least two weeks before their auto-renewal date of the 1st of each month to avoid being charged for the following month. We may also discontinue Services for any reason, at any time, with appropriate notice. You remain responsible for all charges incurred up to the point of termination. 

 

14. Limitation of Liability

We are not liable for any damages or losses arising from use of our Sites or Services, including illness (such as COVID-19), technical issues, or your student’s outcomes. If liability is established, it will be limited to the amount you paid us in the six (6) months before the claim.

 

15. Updates

We may update these terms at any time. The most current version will always be posted on our site and indicated by the “last updated” date. Continued use of our Services means you accept any updates.
